The new rule of applicability of Gratuity to Prasar Bharati employees recruited after 05.10.2007 says:
1. The issue has been examined keeping in view the Prasar Bharati Act, 1990. Prasar Bharati, in exercise of the powers conferred by Section 33 read with sub-section (S) of Section 11 of the Prasar Bharati (Broadcasting Corporation of India) Act, 1990 (2S of 1990) notified the Prasar Bharati (Broadcasting Corporation of India) Conditions of Service and Authorities for Disciplinary Proceedings Regulations, 2016 vide Notification dated 23.11.2016. These Regulations are applicable to all employees recruited by Prasar Bharati after Sth October, 2007.
2. The Regulations dated 23rd November, 2016 provide that “The rules and regulations governing the service conditions of Government servants of the Corresponding grades including Central Civil Services (Conduct) Rules 1964 and Central Civil Services (Classification, Control and Appeal) Rules, 1965 shall, mutatis mutandis, be applicable to the employees” recruited by Prasar Bharati after 5th October, 2007.
3. Accordingly, it has been decided that “Gratuity”, as admissible to the employees on deemed deputation to Prasar Bharati under CCS (Pension) rules, 1972, shall be applicable to the Prasar Bharati employees recruited after 05.10.2007, as below:
I. W.e.f 23.11.2016 i.e., from the date of issue of Prasar Bharati (Broadcasting Corporation of India) Notification on Condition of Service and Authorities for Disciplinary Proceedings Regulations, 2016 dated 23.11.2016.
II. For the Prasar Bharati employees retired/died prior to the date of issue of Regulations, 2016, the gratuity is to be paid as per the Resolution passed by the Prasar Bharati Board in its first meeting i.e. Government Rules and Regulations would be applicable mutatis mutandis to Prasar Bharati employees recruited after 05.10.2007 till Prasar Bharati frames its own regulations/policy.
4. All concerned are requested to take appropriate action in the matter. An Action taken report may also please be submitted to Prasar Bharati Secretariat.
5. This issues with the concurrence of IFD and approval of CEO Prasar Bharati.
